HR Manager - Did You Just Hire Your Next Workers’ Comp Claimant?
Let’s evaluate a typical hire for most companies:
There is an open position so you place an advertisement in the newspaper or online. Multiple resumes come in, you narrow your search to ten people, however only three people show up for the actual job interview. Of the three, you decide to hire Jack. After completing the background and reference checks, Jack is told to show up at 8:00 A.M. Monday morning and report to the HR Department to complete his paperwork.
Monday morning, here is the exchange that takes place:
“Hi, Jack. Welcome to the company. Fill out your paperwork, sit in the break room and watch the safety video and I will take you to work with Charlie, our senior employee. You will watch how Charlie does the job for two or three days, then you’re on your own. We are here if you have any questions. At XYZ Company, we have an open door policy.”

Every Workers' Comp Claim Start with an HR Decision
When I worked as an adjuster, I received countless phone calls from employers saying, “I should have fired him or her,” or, “He or she was a lousy employee,” or, “I’m not sure why I let him or her get away with that,” or, “If I had only let him or her go yesterday, I wouldn’t have this claim on my hands today.” This brings me full circle to why I feel, every workers’ compensation claim starts with an employment decision. As the employer, either you did not provide enough training and oversight to the employee or you hired the wrong employee to do the job or you kept the wrong employee too long. Most workers’ compensation claims can be traced to one of these bad HR decisions.

Employers in Florida hold their breath as Guns in the Workplace Passes Legislative Hurdles
After the recent shooting incidents at Northern Illinois University and at the Wendy’s here in Palm Beach County, I was cautiously optimistic that the Florida Legislators would table the Guns in the Workplace Legislation – I was wrong. Yesterday, the Florida Senate Criminal Justice Committee approved SB1130 – Guns at Work Bill by a vote of 7-1 and for the first time this legislation seems destined to become law.

Is the Florida Workers' Comp Rate Cut Sustainable?
Apparently our Insurance Commissioner, Kevin McCarty, rejected the NCCI’s proposed workers’ compensation rate cuts and demanded a deeper rate reduction. I read numerous articles in various newspapers and journals today – these articles miss the boat completely. The question they should pose to Mr. McCarty and the NCCI is: Is the current rate reduction sustainable?
After working in trenches of the workers’ compensation system for more than 20 years, first as an adjuster and now as a consultant – I do not feel that the rate reductions are sustainable for the long haul. And they may have an adverse impact on the number of carriers willing to write business in Florida. There are 2 areas of concern – one the ability to predict how medical treatment will evolve and the hidden impact of lower rates on employers who have injuries. Both of these concerns are not being addressed in our over-hyped rush to reduce rates.

Is There a Solution to Workplace Injuries?
In 2005, there were 246,300 Non-Fatal Occupational injures or illness with lost work days in Florida. According to the Occupational Safety & Health Statistics Program at the US Bureau of Labor Statistics (BLS) 13% of all injuries occur within 90 Days of employment. 23% occur within 4 hours of arriving at work. The solution to eliminate workplace injuries start when a proactive Injury Prevention Program is implemented.
